Tulare Deck and Fence is a deck and fence contractor based in Tulare, CA. We provide residential outdoor construction services including deck design and construction, fence installation, pergola installation, patio covers, and related services for homeowners in the Central Valley region of California. All services are subject to the execution of a written contract between us and the customer prior to any work beginning.

3. Estimates and Pricing

Estimates provided by Tulare Deck and Fence are based on a site visit, the scope of work discussed, and current material pricing at the time of the estimate. All estimates are provided in writing.

• Estimates are valid for 30 days from the date of issue unless otherwise stated in writing. Material prices and labor costs may change after that period.
• An estimate is not a contract. Work will not begin until a written contract is signed by both parties.
• Changes to the agreed scope of work requested after a contract is signed may result in additional charges. Any change orders must be agreed to in writing before additional work is performed.
• Unforeseen site conditions discovered during construction - such as hidden rot, soil conditions requiring additional engineering, or existing structural issues - may require adjustments to the project scope and price. We will notify you before proceeding with any work that falls outside the original contract.

4. Scheduling and Cancellation

Project start dates are scheduled after a signed contract and deposit are received. Start dates are estimates and may be affected by weather, permit processing times, material availability, or other factors outside our control.

• If you need to cancel or postpone your project after a contract is signed, please notify us in writing as soon as possible. Deposits may be partially or fully non-refundable depending on materials already ordered or work already performed.
• We reserve the right to reschedule project start dates due to weather conditions, crew availability, or circumstances outside our control. We will provide reasonable advance notice when rescheduling is necessary.
• Cancellation of a project after materials have been ordered may result in restocking fees or material costs that cannot be recovered. These costs will be communicated to you before any deductions are made from your deposit.

5. Payment Terms

Payment schedules are outlined in each individual project contract. General terms apply as follows:

• A deposit is required to secure your project start date. The deposit amount will be specified in your written contract.
• Progress payments may be required at key milestones as defined in the contract (for example, after framing is complete or after materials are delivered to the site).
• Final payment is due upon project completion, defined as the completion of all work outlined in the contract and a final walkthrough with the customer.
• Payments are accepted by check, bank transfer, or other methods specified in the contract.
• Accounts that are past due by more than 10 days may be subject to a late fee as specified in the project contract.

6. Permits and Compliance

Tulare Deck and Fence will obtain all required building permits for work that requires them under applicable local and state regulations. Permit fees are typically included in the project estimate. The customer is responsible for obtaining any required HOA approvals before the permit application is submitted. Delays caused by HOA review processes or corrections required by the building department may affect the project timeline and are not the responsibility of Tulare Deck and Fence.

7. Warranty Disclaimers

Tulare Deck and Fence warrants that all work will be performed in a workmanlike manner consistent with applicable building codes. Specific warranty terms, if any, will be outlined in the project contract.

Manufacturer warranties on materials (such as composite decking boards) are passed through to the customer and are subject to the terms of each manufacturer. We do not extend or modify manufacturer warranties.

The warranty on workmanship does not cover damage resulting from misuse, improper maintenance, modifications made by the customer or a third party, acts of nature, or normal wear and tear.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Tulare Deck and Fence shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the use of our website or the services we provide, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of a service engagement shall not exceed the total amount paid by you for the specific services giving rise to the claim.
